Sequence of facts


The following are a collation of the sequence of events from the various parties - The Somerville House School Councillors (Independents) and the Somerville House Foundation (SHF).

The SHF is a separate legal entity to the School, not a "sub-committee" as Chairman Greg Adsett referred to on ABC Radio with Steve Austin.

The SHSCI's are Dr Sarah Kelley (lawyer), Mr Ian Macdonald (educator and former Principal of St Laurences College), and Dr Russell Bird (medical doctor, past parent, sole remaining independent councillor).

Rick Hiley was the Business Manager to Somerville House (School), and the Company Secretary to the SHF.

Rick Hiley is now Executive Manager of the PMSA.

This means the schools all now report directly to him.

Events

1.17th May SH Foundation Board Meeting. (Board Minutes)

2.19th May, 1 business arising in SHF Board Minutes which required Rick Hiley to only forward an email. (Board Minutes)

3.21st May, SH School turns on computer recording on R Hiley’s computer after tipoff from whistle blower. (SHF Independent audit report)

4.24th May, Rick Hiley is offered/accepts role with PMSA. (School Council Investigation)

5.26th May, Rick Hiley downloads 6,000+ files. (SHF Independent audit report)

6.6th June, Rick Hiley appointed by PMSA as Executive Manager. ( Statement by Dr S Kelly and I MacDonald)

7.7th June, SH School Council accept Rick Hiley’s resignation. (Statement by Dr S Kelly and I MacDonald)

8.20th June, PMSA commence investigation into complaint from Rick Hiley. (Statement by Dr S Kelly and I MacDonald and PMSA Laywers)

9.22nd June, Somerville House provide material to PMSA, including data breach and text messages. (Statement by Dr S Kelly and I MacDonald)

 

Somerville House Foundation involvement

10.25th August, Principal Kearney and SHSC advises SHF of data breach. (Letter to SHF from SH). Note letter was not opened until 29thAugust by SHF.

11.29th August, SHF legal advice, gives Rick Hiley and PMSA Chair Greg Adsett enforceable undertaking to destroy stolen data. (Letter from Brown Wright Stein, lawyers for SHF)

12.30th August, Principal Kearney takes early leave. (Email from SH to SHF Chair)

13.4th September, SHF Members advised of data breach. ( Letter to members by SHF)

14.4th September, Hopgood & Ganim act for PMSA, refuse to sign enforceable undertaking. (Letter from Hopgood Ganim)

15.6th September, SHF (separate legal entity) resend request for enforceable undertaking and confirm that no Member, Director or Officer has the right to personal identifying information, donor amounts, corporate records or Directors consents with signatures. (Letter from Brown Wright Stein)

16.11th September, Hopgood & Ganim acting for PMSA advise files were deleted still but will not sign enforceable undertaking or assurances. (Letter from Hopgood Ganim)

17.13th September, Chair SH Foundation Virginia Buttula and PMSA Chair Greg Adsett meet & advised of need for independent audit of files. (Confirmation of Meeting V Buttula)

18.19th & 20th September SH Foundation auditors review access, and number of files stolen. (SHF Independent audit report)

19.5th October, independent audit report released, confirming over 6,000 files taken. These include Lifeline Qld, and TAFE Qld . Rick Hiley was a former employee of both organisations. These files found on his drive in school computer system. (SHF Independent audit report)

20.6th October, SHF Chair Virginia Buttula meets PMSA Chair Greg Adsett and advises of additional data breach (TAFE and Lifeline). PMSA Chair advises verbally that he personally destroyed the files and placed drive in a rubbish bin. No written confirmation could be obtained. (Board Minutes)

21.10th October, Somerville House advised Principal Kearney has resigned. (Public Announcement by PMSA)
